Judicial Misconduct Complaints

The following is the complaint filed against District Court Judge Paul G. Cassell of the District of Utah. The reader may make his or her own decision about whether the plaintiffs in the case received justice in Judge Cassell's courtroom.  

Judicial Misconduct Complaint - Cassell

The following is a complaint filed against the panel that heard the case on appeal. That panel consisted of Tenth Circuit Court of Appeals Judge Timothy Tymkovich, District Court Judge Claire V. Eagan of the Northern District of Oklahoma and Senior Judge Robert McWilliams. Once again, the reader should decide whether we received a fair hearing in front of this panel. 

Judicial Misconduct Complaint - Panel

The following complaint was filed against Tenth Circuit Court Judge Deanell Tacha who is supposed to supervise that court. We maintain that she has failed to do so allowing judges to behave as they did in our case. It should be noted that this complaint does not meet the requirements for judicial misconduct complaints. However, it was filed for strategic reasons which will become clear after we post letters that were sent to U.S. Supreme Court Chief Justice John Roberts and Justice Stephen Breyer. Each Supreme court justice has a circuit court assignment and that justice oversees that court. Justice Breyer is assigned to the Tenth Circuit. Although the Supreme Court denied our petition for writ of certiorari (appeal) we maintain that they should address our allegations of  serious misconduct in that court. Both justices have spoken out about the need to increase compensation for federal judges. We argue that unless the judiciary reforms itself and can assure average Americans who file meritorious claims that they will be on a level playing field with the powerful and politically-well connected then there should be no pay raise.

Judicial Misconduct Complaint - Tacha

The purpose of these complaints is twofold. First, it was to give the Tenth Circuit (including Chief Judge Deanell Tacha) a chance to address this case and these complaints although we long ago stopped expecting any justice from the judges within the Tenth Circuit. Second, and more important, we have documented this case and it abuses from beginning to end. Should any judge involved in this case ever be nominated to a higher judicial post or government position we intend to testify against them in front of the Senate committee reviewing the credentials and qualifications of that nominee.  

The following links will take you to the letters of complaint that I sent to Supreme Court Justice Stephen Breyer and Chief Justice John Roberts. I later received a response from the Clerk of the Supreme Court in response to the letter I sent to Justice Breyer. It was a basic "there's nothing we can do" response and it suggested I file a complaint with the clerk of the Tenth Circuit Court of Appeals. Yeah, duh, we already did that. Chief Justice Roberts has failed to respond to my letter although Senator Hatch alluded to in his most recent missive to me. Do these judges really deserve a fifty one percent pay raise?
